Welcome to Nerdy Neighbor Designs. These Terms & Conditions govern purchases made through our website, custom and personalized orders, and purchases made directly from us through local or in-person sales.
By placing an order with Nerdy Neighbor Designs, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
1. About Nerdy Neighbor Designs
Nerdy Neighbor Designs is a family-owned and operated business specializing in custom and personalized products, including laser engraving, UV printing, 3D printing, crystal engraving, and other custom-made products.
Because many of our products are created specifically for each customer, certain policies differ from those of traditional retail stores.
2. Orders & Payment
Payment is due in full at the time of checkout or when an order is placed unless otherwise agreed to in writing by Nerdy Neighbor Designs.
An order is not considered confirmed until payment has been successfully received.
We reserve the right to decline or cancel an order when necessary, including orders containing content we cannot legally or reasonably reproduce, orders that cannot be completed with the requested specifications, suspected fraudulent transactions, pricing or listing errors, or circumstances outside our reasonable control.
If we cancel an order before production begins, any applicable payment collected for the canceled portion of the order will be refunded.
3. Custom & Personalized Products
Many Nerdy Neighbor Designs products are made specifically for the customer. This may include names, photographs, logos, artwork, messages, dates, custom dimensions, colors, or other customer-selected elements.
All custom and personalized products are final sale.
Custom or personalized products cannot be returned, exchanged, or refunded because of customer preference, incorrect information supplied by the customer, spelling or grammatical errors supplied by the customer, incorrect sizing or selections made by the customer, or a change of mind after production has begun.
Customers are responsible for carefully reviewing all information submitted with their order.
4. Proofs & Customer Approval
For certain custom orders, Nerdy Neighbor Designs may provide a digital proof or mockup before production.
When a proof is provided, the customer is responsible for reviewing all aspects of the design, including spelling, names, dates, layout, orientation, images, and other customization details.
Once a proof has been approved, Nerdy Neighbor Designs will produce the item based on that approval. Errors contained in an approved proof are the customer's responsibility.
Changes requested after approval or after production has begun may result in additional charges or may not be possible.
5. Colors, Materials & Product Variations
Product photographs and digital mockups are intended to provide a reasonable representation of the finished product. Actual products may vary slightly from what appears on a computer, tablet, or mobile device.
Natural materials such as wood, slate, stone, leather, and similar materials may contain variations in grain, texture, color, knots, markings, or engraving appearance. These natural variations are not considered defects.
Colors produced through UV printing and other printing processes may also vary slightly from digital images due to differences in materials, displays, inks, lighting, and production methods.
Handmade and custom-produced products may have minor variations from one item to another. These variations are part of the custom manufacturing process and do not necessarily constitute a defect.
6. Customer-Supplied Images, Logos & Artwork
By submitting photographs, logos, artwork, graphics, trademarks, text, or other content to Nerdy Neighbor Designs, you represent that you own the content or have the necessary permission or legal right to use and reproduce it for the requested product.
You authorize Nerdy Neighbor Designs to reproduce, modify, resize, crop, format, or otherwise process the supplied content as reasonably necessary to fulfill your order.
Nerdy Neighbor Designs is not responsible for copyright, trademark, privacy, publicity-right, or other intellectual-property claims resulting from customer-supplied content.
We reserve the right to refuse any artwork or content that we reasonably believe may violate applicable law, intellectual-property rights, or our business policies.
7. Image Quality
The quality of custom printing or engraving depends in part on the quality of the artwork, photograph, or other file provided by the customer.
Low-resolution, blurry, compressed, poorly lit, or otherwise low-quality source images may affect the finished product. Nerdy Neighbor Designs will make reasonable efforts to produce the best possible result but cannot guarantee that poor-quality source material can be corrected.
8. Cancellations
Orders for standard, non-custom products may be canceled before fulfillment or production begins, subject to our approval.
Custom and personalized orders may only be canceled before design work or production has begun.
Once custom design work, printing, engraving, manufacturing, or other production has started, the order cannot normally be canceled or refunded.
9. Returns, Exchanges & Refunds
Custom and personalized products are final sale and are not eligible for returns or exchanges, except when an item arrives damaged, defective, or materially different from the approved design due to an error by Nerdy Neighbor Designs.
For eligible non-custom products, any return or exchange will be handled according to the return policy displayed on our website at the time of purchase.
Customers should contact us promptly after receiving an order if there is a problem.
We may request photographs of the product, packaging, shipping label, or damage so we can evaluate the issue.
When Nerdy Neighbor Designs determines that we made an error, we may, at our discretion and as appropriate under applicable law, repair the product, replace the product, reproduce the affected portion of the order, or issue a refund.
10. Shipping & Delivery
Shipping and delivery estimates are estimates only and are not guaranteed delivery dates unless specifically stated otherwise in writing.
Once a package has been transferred to a shipping carrier, delivery times may be affected by carrier delays, weather, holidays, incorrect addresses, or other circumstances outside the control of Nerdy Neighbor Designs.
Customers are responsible for providing a complete and accurate shipping address when placing an order.
Additional shipping charges resulting from an incorrect or incomplete address supplied by the customer may be the customer's responsibility.
11. Shipping Damage
Customers should inspect packages promptly upon delivery.
If an order arrives damaged, please retain the product and all original packaging and contact Nerdy Neighbor Designs as soon as reasonably possible. Photographs of the damaged product and packaging may be required to process a replacement or shipping claim.
Please do not discard damaged items or packaging until we have completed our review.
12. Local Pickup & In-Person Sales
Products purchased or collected locally should be inspected at the time of pickup whenever reasonably possible.
Custom and personalized products purchased locally or in person remain subject to the same final-sale policy as custom products purchased through our website.
Once an order has been accepted by the customer, subsequent damage caused by handling, transportation, installation, misuse, or improper storage is not the responsibility of Nerdy Neighbor Designs.
13. Product Use & Safety
Customers are responsible for using products appropriately and for their intended purpose.
Some products may contain small parts, sharp edges, glass, crystal, wood, plastics, magnets, batteries, electronic components, or other materials that require appropriate handling.
Unless specifically identified as such, products should not be assumed to be toys, food-safe, dishwasher-safe, microwave-safe, weatherproof, waterproof, child-safe, or intended for unsupervised use by children.
Customers should follow any care or safety instructions supplied with a product.
14. 3D-Printed Products
3D-printed products may contain minor layer lines, seams, surface variations, or other characteristics inherent to additive manufacturing. These characteristics are generally normal and are not considered manufacturing defects.
3D-printed materials may also be affected by excessive heat, prolonged sunlight, moisture, stress, or improper use depending on the material used.
15. Engraved & Printed Products
Laser engraving, crystal engraving, and UV printing can produce slightly different results depending on the material, surface, coating, grain, transparency, shape, and other physical characteristics of the product.
Exact positioning, coloration, engraving depth, or appearance may vary slightly between products, particularly when working with natural or individually manufactured materials.
16. Intellectual Property
Unless otherwise stated, the Nerdy Neighbor Designs name, logo, website content, original graphics, product photographs, original designs, and other materials created by Nerdy Neighbor Designs are owned by or licensed to Nerdy Neighbor Designs and may not be copied, reproduced, distributed, or commercially used without permission.
Customer-owned logos, photographs, artwork, trademarks, and other submitted materials remain the property of their respective owners.
17. Website Information & Pricing
We make reasonable efforts to ensure that product descriptions, specifications, pricing, availability, and other information on our website are accurate.
However, typographical errors, pricing errors, technical errors, or incorrect product information may occasionally occur.
Nerdy Neighbor Designs reserves the right to correct errors, update information, change pricing, or cancel an affected order when necessary. If an order is canceled because of our error, any applicable amount already paid for the canceled item will be refunded.
18. Promotions & Discount Codes
Promotions, coupons, discount codes, and special offers may be subject to additional restrictions or expiration dates.
Unless specifically stated otherwise, promotions cannot be combined and have no cash value. Nerdy Neighbor Designs reserves the right to modify or discontinue promotions as permitted by applicable law.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Nerdy Neighbor Designs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, possession, or use of our products.
To the fullest extent permitted by law, our total liability relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim.
Nothing in these Terms & Conditions excludes or limits rights or remedies that cannot legally be excluded or limited.
20. Force Majeure
Nerdy Neighbor Designs will not be responsible for delays or failure to perform caused by events reasonably outside our control, including severe weather, natural disasters, power or internet outages, equipment failures, supply shortages, carrier disruptions, governmental actions, or similar events.
We will make reasonable efforts to communicate significant delays and complete affected orders as soon as reasonably possible.
21. Privacy
Information collected through our website and ordering process will be handled in accordance with our Privacy Policy and applicable law.
Payment information may be processed by third-party payment providers. Nerdy Neighbor Designs does not necessarily receive or store complete payment-card information processed through those providers.
22. Changes to These Terms
Nerdy Neighbor Designs may update these Terms & Conditions periodically.
Changes will become effective when the revised Terms & Conditions are posted on our website unless otherwise required by law. The Terms & Conditions in effect at the time an order is placed will generally govern that transaction.
23. Governing Law
These Terms & Conditions and transactions with Nerdy Neighbor Designs will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
24. Severability
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
